OFFICE OF THE PRESIDENT MEDICAL COLLEGE OF SOUTH CAROLINA April 21, 1969 Mr. John Henry Mills Comptroller General State of South Carolina Wade Hampton Office Building Columbia, South Carolina 29201 Dear Mr. Mills: As you are aware, the Medical College of South Carolina entered into an agreement with Attorney Knox L. Haynsworth, Jr., of Greenville, South Carolina to represent the Medical College in all matters pertaining to labor relations law. This agreement provided that Mr. Haynsworth be paid a retainer fee of $100 per month. The retainer covered routine matters which arose in the labor field. In addition, the Hospital agreed to pay Mr. Haynsworth on the basis of $50 per hour plus expenses for all work which he and his Firm did over and above the retainer fee. This $50 per hour would cover such things as court litigation, legal advice during strikes, etc. Of course, the Hospital has been given credit for the $100 retainer each time Mr. Haynsworth has submitted a statement. The arrangement worked out between the Hospital and Mr. Haynsworth's Law Firm was specifically agreed to by the Board of Trustees of the Medical College of South Carolina. Mr. Haynsworth was told of the Board of Trustees' action and was specifically informed that both the retainer arrangement and the $50 per hour fee had been agreed to by the Attorney General's office. As you are aware, there appears to be some misunderstanding between the Attorney General's office and the Medical College of South Carolina regarding the $50 per hour fee. However, I will assure you that, notwithstanding any possible misunderstanding, Mr. Haynsworth was told that the retainer arrangement and the $50 per hour fee had both been approved by the Attorney General. Mr. Haynsworth has been working with the Hospital since October of 1968. Through April 18, 1969, the Hospital has paid to Mr. Haynsworth's Firm in fees a sum of $13,850. The major portion of these fees arose out of the current strike which is going on at the Medical College. Because of the legal ramifications of the strike in keeping the hospital open, and because of the enormous amount of court litigation, it has been necessary that Mr. Haynsworth spend virtually all of his time this past month working directly for the Hospital.
